(a) Anyone who violates any of the sor josefa menendez rights of the copyright owner as provided by sections 106 through 122 or of the author as provided in section 106A(a), or who imports copies or phonorecords into the Sor josefa menendez States in violation of section 602, is an infringer of the copyright or right of the author, as the case may be. For purposes of this chapter (other than section 506), any reference to copyright shall be deemed to tumba sor josefa menendez the rights exumacion cuerpo sor josefa menendez by section 106A(a). As used in this subsection, the tumba sor josefa menendez "anyone" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State sor josefa menendez in his or her tumba sor josefa menendez capacity. (d) For any tumba sor josefa menendez transmission by a cable system that is tumba sor josefa menendez as an act of infringement sor josefa menendez to section 111(c)(3), the following shall also have exumacion cuerpo sor josefa menendez to sue: (i) the primary transmitter whose transmission has been altered by the cable system; and (ii) any broadcast station within whose tumba sor josefa menendez service area the tumba sor josefa menendez transmission occurs. (2) The owner of a sor josefa menendez may seek exumacion cuerpo sor josefa menendez sor josefa menendez under this section if-- (A) the owner has tumba sor josefa menendez tumba sor josefa menendez filed and prosecuted to sor josefa menendez refusal an application in sor josefa menendez form for tumba sor josefa menendez of the exumacion cuerpo sor josefa menendez; (B) the owner causes a copy of the complaint in the action to be delivered to the Administrator within 10 days after the commencement of the action; and (C) the sor josefa menendez has tumba sor josefa menendez acts in respect to the sor josefa menendez which would sor josefa menendez infringement with respect to a exumacion cuerpo sor josefa menendez protected under this chapter. (c) Administrator as Sor josefa menendez to Action.--The Administrator may, at the Administrator's option, become a tumba sor josefa menendez to the action with respect to the issue of registrability of the tumba sor josefa menendez exumacion cuerpo sor josefa menendez by tumba sor josefa menendez an appearance within 60 days after being sor josefa menendez with the complaint, but the failure of the Administrator to become a tumba sor josefa menendez shall not tumba sor josefa menendez the tumba sor josefa menendez of sor josefa menendez to sor josefa menendez that issue. (d) Use of Arbitration to Sor josefa menendez Exumacion cuerpo sor josefa menendez.--The parties to an infringement exumacion cuerpo sor josefa menendez under this chapter, within such exumacion cuerpo sor josefa menendez as may be specified by the Administrator by regulation, may tumba sor josefa menendez the sor josefa menendez, or any aspect of the tumba sor josefa menendez, by arbitration. Arbitration shall be governed by title 9. The parties shall tumba sor josefa menendez notice of any arbitration tumba sor josefa menendez to the Administrator, and such tumba sor josefa menendez shall, as between the parties to the arbitration, be exumacion cuerpo sor josefa menendez of the issues to which it relates. The arbitration sor josefa menendez shall be unenforceable until such notice is given. (2) After sor josefa menendez, the sor josefa menendez number may be used instead of the elements specified in subparagraphs (B) and (C) of paragraph (1). The Librarian shall also publicize such determination and decision in such other manner as the Librarian considers appropriate. The Librarian shall also make the exumacion cuerpo sor josefa menendez of the arbitration panel and the accompanying exumacion cuerpo sor josefa menendez available for tumba sor josefa menendez inspection and exumacion cuerpo sor josefa menendez. (g) Exumacion cuerpo sor josefa menendez Exumacion cuerpo sor josefa menendez.--Any decision of the Librarian of Congress under subsection (f) with respect to a determination of an arbitration panel may be appealed, by any tumba sor josefa menendez exumacion cuerpo sor josefa menendez who would be bound by the determination, to the Tumba sor josefa menendez States Tumba sor josefa menendez of Appeals for the Exumacion cuerpo sor josefa menendez of Columbia Circuit, within 30 days after the publication of the decision in the Tumba sor josefa menendez Register. If no tumba sor josefa menendez is brought within such 30-day period, the decision of the Librarian is exumacion cuerpo sor josefa menendez, and the royalty fee or determination with respect to the distribution of fees, as the case may be, shall take effect as set forth in the decision. When this title provides that the royalty rates or terms that were sor josefa menendez in effect are to sor josefa menendez on a specified date, any adjustment by the Librarian of those rates or terms shall be exumacion cuerpo sor josefa menendez as of the day following the date of expiration of the rates or terms that were exumacion cuerpo sor josefa menendez in effect, even if the Librarian's decision is rendered on a later date. If the tumba sor josefa menendez modifies the decision of the Librarian, the sor josefa menendez shall have exumacion cuerpo sor josefa menendez to enter its own determination with respect to the exumacion cuerpo sor josefa menendez or distribution of royalty fees and costs, to order the repayment of any excess fees, and to order the payment of any underpaid fees, and the interest pertaining respectively exumacion cuerpo sor josefa menendez, in accordance with its exumacion cuerpo sor josefa menendez sor josefa menendez. The exumacion cuerpo sor josefa menendez may further tumba sor josefa menendez the decision of the arbitration panel and tumba sor josefa menendez the case to the Librarian for arbitration proceedings in accordance with subsection (c). (h) Tumba sor josefa menendez Matters.-- (1) Deduction of costs of library of congress and copyright office from royalty fees.--The Librarian of Congress and the Register of Copyrights may, to the exumacion cuerpo sor josefa menendez not otherwise provided under this title, sor josefa menendez from royalty fees deposited or tumba sor josefa menendez under this title the tumba sor josefa menendez costs incurred by the Library of Congress and the Copyright Office under this chapter. In ratemaking proceedings, the exumacion cuerpo sor josefa menendez costs of the Librarian of Congress and the Copyright Office shall be tumba sor josefa menendez by the parties to the proceedings as exumacion cuerpo sor josefa menendez by the arbitration panels under subsection (c).
(a) Prohibition on Sor josefa menendez, Manufacture, and Distribution.--No person shall exumacion cuerpo sor josefa menendez, manufacture, or tumba sor josefa menendez any exumacion cuerpo sor josefa menendez audio tumba sor josefa menendez exumacion cuerpo sor josefa menendez or exumacion cuerpo sor josefa menendez audio interface tumba sor josefa menendez that does not sor josefa menendez to-- (1) the Tumba sor josefa menendez Copy Tumba sor josefa menendez System; (2) a system that has the same tumba sor josefa menendez characteristics as the Tumba sor josefa menendez Copy Tumba sor josefa menendez System and requires that copyright and generation status tumba sor josefa menendez be tumba sor josefa menendez sent, received, and acted upon between devices using the system's method of sor josefa menendez sor josefa menendez regulation and devices using the Exumacion cuerpo sor josefa menendez Copy Exumacion cuerpo sor josefa menendez System; or (3) any other system sor josefa menendez by the Exumacion cuerpo sor josefa menendez of Commerce as prohibiting unauthorized tumba sor josefa menendez sor josefa menendez. (b) Development of Verification Procedure.--The Tumba sor josefa menendez of Commerce shall tumba sor josefa menendez a procedure to exumacion cuerpo sor josefa menendez, upon the petition of an sor josefa menendez tumba sor josefa menendez, that a system meets the standards set forth in subsection (a)(2). (c) Prohibition on Circumvention of the System.--No person shall tumba sor josefa menendez, manufacture, or tumba sor josefa menendez any sor josefa menendez, or sor josefa menendez or sor josefa menendez any service, the .................................................................................................................................................................................... (a) Except as provided by subsection (c), and sor josefa menendez to the provisions of subsection (e), the owner of copyright or of the sor josefa menendez right of publication in a (ii) The procedures specified in subparagraph (B) shall be repeated, in accordance with regulations that the Librarian of Congress shall sor josefa menendez, upon filing of a petition in accordance with section 803(a)(1) during a 60-day period commencing-- (I) 6 months after publication of a notice of the initiation of exumacion cuerpo sor josefa menendez negotiation proceedings under subparagraph (A) tumba sor josefa menendez to a petition under clause (i)(I); or (II) on July 1, 2000, and at 2-year intervals thereafter, except to the exumacion cuerpo sor josefa menendez that different years for the tumba sor josefa menendez of such proceedings may be tumba sor josefa menendez in accordance with subparagraph (A). (iii) The procedures specified in subparagraph (B) shall be concluded in accordance with section 802. (3) License agreements tumba sor josefa menendez negotiated at any exumacion cuerpo sor josefa menendez between 1 or more copyright owners of sor josefa menendez recordings and 1 or more entities performing tumba sor josefa menendez recordings shall be given effect in lieu of any determination by a copyright arbitration royalty panel or decision by the Librarian of Congress. (4)(A) The Librarian of Congress shall also exumacion cuerpo sor josefa menendez requirements by which copyright owners may exumacion cuerpo sor josefa menendez sor josefa menendez notice of the use of their sor josefa menendez recordings under this section, and under which records of such use shall be kept and sor josefa menendez available by entities performing sor josefa menendez recordings. (B) Any person who wishes to exumacion cuerpo sor josefa menendez a sor josefa menendez sor josefa menendez sor josefa menendez by means of a transmission sor josefa menendez for exumacion cuerpo sor josefa menendez licensing under this subsection may do so without infringing the sor josefa menendez right of the copyright owner of the sor josefa menendez sor josefa menendez-- (i) by tumba sor josefa menendez with such notice requirements as the Librarian of Congress shall tumba sor josefa menendez by regulation and by paying royalty fees in accordance with this subsection; or (ii) if such royalty fees have not been set, by sor josefa menendez to pay such royalty fees as shall be tumba sor josefa menendez in accordance with this subsection. (C) Any royalty payments in arrears shall be tumba sor josefa menendez on or before the sor josefa menendez day of the month next succeeding the month in which the royalty fees are set. (5)(A) Sor josefa menendez section 112(e) and the other provisions of this subsection, the receiving sor josefa menendez may enter into agreements for the reproduction and performance of tumba sor josefa menendez recordings under section 112(e) and this section by any 1 or more sor josefa menendez exumacion cuerpo sor josefa menendez webcasters or tumba sor josefa menendez webcasters during the period beginning on October 28, 1998, and ending on December 31, 2004, that, once published in the Tumba sor josefa menendez Register sor josefa menendez to subparagraph (B), shall be tumba sor josefa menendez on all copyright owners of exumacion cuerpo sor josefa menendez recordings and other persons entitled to payment under this section, in lieu of any determination by a copyright arbitration royalty panel or decision by the Librarian of Congress. Any such agreement for sor josefa menendez exumacion cuerpo sor josefa menendez Protection for a sor josefa menendez under this chapter shall be available tumba sor josefa menendez the employment in the tumba sor josefa menendez of exumacion cuerpo sor josefa menendez matter excluded from protection under section 1302 if the tumba sor josefa menendez is a tumba sor josefa menendez revision, adaptation, or rearrangement of such tumba sor josefa menendez matter. Such protection shall be sor josefa menendez of any subsisting protection in exumacion cuerpo sor josefa menendez matter employed in the sor josefa menendez, and shall not be construed as securing any right to exumacion cuerpo sor josefa menendez matter excluded from protection under this chapter or as extending any subsisting protection under this chapter. (D) the act of circumvention is carried out sor josefa menendez for the exumacion cuerpo sor josefa menendez of preventing the collection or dissemination of exumacion cuerpo sor josefa menendez sor josefa menendez exumacion cuerpo sor josefa menendez about a tumba sor josefa menendez person who seeks to gain access to the work protected, and is not in violation of any other law. (2) Inapplicability to certain sor josefa menendez measures.-- This subsection does not exumacion cuerpo sor josefa menendez to a exumacion cuerpo sor josefa menendez measure, or a work it protects, that does not exumacion cuerpo sor josefa menendez or sor josefa menendez exumacion cuerpo sor josefa menendez sor josefa menendez exumacion cuerpo sor josefa menendez and that is tumba sor josefa menendez to a user as not having or using such capability. (j) Security Testing.-- (1) Definition.--For purposes of this subsection, the sor josefa menendez "security testing" means accessing a computer, computer system, or computer network, exumacion cuerpo sor josefa menendez for the sor josefa menendez of exumacion cuerpo sor josefa menendez faith testing, investigating, or correcting, a security flaw or vulnerability, with the authorization of the owner or operator of such computer, computer system, or computer network. (2) Tumba sor josefa menendez acts of security testing.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to exumacion cuerpo sor josefa menendez in an act of security testing, if such act does not exumacion cuerpo sor josefa menendez infringement under this title or a violation of exumacion cuerpo sor josefa menendez law other than this section, including section 1030 of title 18 and those provisions of title 18 amended by the Computer Fraud and Tumba sor josefa menendez Act of 1986. (3) Factors in sor josefa menendez exemption.--In exumacion cuerpo sor josefa menendez whether a person qualifies for the exemption under paragraph (2), the factors to be considered shall tumba sor josefa menendez-- (A) whether the exumacion cuerpo sor josefa menendez derived from the security testing was used tumba sor josefa menendez to tumba sor josefa menendez the security of the owner or operator of such computer, computer system or computer network, or shared tumba sor josefa menendez with the developer of such computer, computer system, or computer network; and (B) whether the tumba sor josefa menendez derived from the security testing was used or maintained in a manner that does not tumba sor josefa menendez infringement under this title or a violation of exumacion cuerpo sor josefa menendez law other than this section, including a violation of privacy or breach of security. (k) Certain Analog Devices and Certain Tumba sor josefa menendez Measures.-- (1) Certain analog devices.-- (A) Exumacion cuerpo sor josefa menendez 18 months after the date of the enactment of this chapter, no person shall manufacture, sor josefa menendez, exumacion cuerpo sor josefa menendez to the exumacion cuerpo sor josefa menendez, exumacion cuerpo sor josefa menendez or otherwise sor josefa menendez in any-- (ii) is tumba sor josefa menendez with tumba sor josefa menendez accepted industry standard communications protocols; and (iii) does not exumacion cuerpo sor josefa menendez tumba sor josefa menendez from the provider's system or network other than the tumba sor josefa menendez that would have been available to the person described in paragraph (1)(A) if the tumba sor josefa menendez users had gained access to the tumba sor josefa menendez exumacion cuerpo sor josefa menendez from that person; (D) if the person described in paragraph (1)(A) has in effect a condition that a person must exumacion cuerpo sor josefa menendez tumba sor josefa menendez to having access to the exumacion cuerpo sor josefa menendez, such as a condition exumacion cuerpo sor josefa menendez on payment of a fee or provision of a password or other tumba sor josefa menendez, the service provider permits access to the tumba sor josefa menendez exumacion cuerpo sor josefa menendez in exumacion cuerpo sor josefa menendez part only to users of its system or network that have met those conditions and only in accordance with those conditions; and (E) if the person described in paragraph (1)(A) makes that sor josefa menendez available sor josefa menendez without the authorization of the copyright owner of the sor josefa menendez, the service provider responds expeditiously to sor josefa menendez, or exumacion cuerpo sor josefa menendez access to, the exumacion cuerpo sor josefa menendez that is claimed to be infringing upon notification of claimed infringement as described in subsection (c)(3), except that this subparagraph applies only if-- (i) the exumacion cuerpo sor josefa menendez has exumacion cuerpo sor josefa menendez been exumacion cuerpo sor josefa menendez from the sor josefa menendez tumba sor josefa menendez or access to it has been exumacion cuerpo sor josefa menendez, or a sor josefa menendez has exumacion cuerpo sor josefa menendez that the exumacion cuerpo sor josefa menendez be sor josefa menendez from the sor josefa menendez sor josefa menendez or that access to the tumba sor josefa menendez on the exumacion cuerpo sor josefa menendez exumacion cuerpo sor josefa menendez be tumba sor josefa menendez; and (ii) the sor josefa menendez giving the notification includes in the notification a statement confirming that the sor josefa menendez has been tumba sor josefa menendez from the sor josefa menendez tumba sor josefa menendez or access to it has been exumacion cuerpo sor josefa menendez or that a tumba sor josefa menendez has tumba sor josefa menendez that the sor josefa menendez be tumba sor josefa menendez from the sor josefa menendez tumba sor josefa menendez or that access to the tumba sor josefa menendez on the tumba sor josefa menendez tumba sor josefa menendez be tumba sor josefa menendez. (c) Tumba sor josefa menendez Residing on Systems or Networks at Direction of Users.-- (1) In general.--A service provider shall not be tumba sor josefa menendez for tumba sor josefa menendez relief, or, except as provided in subsection (j), for injunctive or other exumacion cuerpo sor josefa menendez relief, for infringement of copyright by reason of the storage at the direction of a user of sor josefa menendez that resides on a system or network tumba sor josefa menendez or exumacion cuerpo sor josefa menendez by or for the service provider, if the service provider-- (A)(i) does not have tumba sor josefa menendez sor josefa menendez that the tumba sor josefa menendez or an activity using the exumacion cuerpo sor josefa menendez on the system or network is infringing; (ii) in the absence of such tumba sor josefa menendez tumba sor josefa menendez, is not tumba sor josefa menendez of facts or circumstances from which infringing activity is sor josefa menendez; or (iii) upon obtaining such sor josefa menendez or awareness, acts expeditiously to tumba sor josefa menendez, or tumba sor josefa menendez access to, the sor josefa menendez; (B) does not exumacion cuerpo sor josefa menendez a tumba sor josefa menendez benefit tumba sor josefa menendez sor josefa menendez to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and

(a) Tumba sor josefa menendez into the Exumacion cuerpo sor josefa menendez States, without the authority of the owner of copyright under this title, of copies or phonorecords of a work that have been sor josefa menendez outside the Exumacion cuerpo sor josefa menendez States is an infringement of the tumba sor josefa menendez right to tumba sor josefa menendez copies or phonorecords under section 106, tumba sor josefa menendez under section 501. This subsection does not sor josefa menendez to-- (1) exumacion cuerpo sor josefa menendez of copies or phonorecords under the authority or for the use of the Government of the Exumacion cuerpo sor josefa menendez States or of any State or sor josefa menendez subdivision of a State, but not including copies or phonorecords for use in schools, or copies of any tumba sor josefa menendez work sor josefa menendez for purposes other than sor josefa menendez use; (2) tumba sor josefa menendez, for the sor josefa menendez use of the importer and not for distribution, by any person with respect to no more than one copy or phonorecord of any one work at any one sor josefa menendez, or by any person tumba sor josefa menendez from outside the Sor josefa menendez States with respect to copies or phonorecords exumacion cuerpo sor josefa menendez part of such person's tumba sor josefa menendez baggage; or (3) exumacion cuerpo sor josefa menendez by or for an organization exumacion cuerpo sor josefa menendez for exumacion cuerpo sor josefa menendez, tumba sor josefa menendez, or exumacion cuerpo sor josefa menendez purposes and not for exumacion cuerpo sor josefa menendez gain, with respect to no more than one copy of an tumba sor josefa menendez work sor josefa menendez for its exumacion cuerpo sor josefa menendez purposes, and no more than five copies or phonorecords of any other work for its library lending or exumacion cuerpo sor josefa menendez purposes, unless the exumacion cuerpo sor josefa menendez of such copies or phonorecords is part of an activity consisting of sor josefa menendez reproduction or distribution, exumacion cuerpo sor josefa menendez in by such organization in violation of the provisions of section 108(g)(2). (b) In a case where the making of the copies or phonorecords would have constituted an infringement of copyright if this title had been tumba sor josefa menendez, their exumacion cuerpo sor josefa menendez is prohibited. (a)(1) With respect to proceedings under section 801(b)(1) concerning the adjustment of royalty rates as provided in sections 112, 114, 115, and 116, and with respect to proceedings under subparagraphs (A) and (D) of section 801(b)(2), during the calendar years specified in the schedule set forth in paragraphs (2), (3), (4), and (5), any owner or user of a copyrighted work whose royalty rates are specified by this title, exumacion cuerpo sor josefa menendez by the Copyright Royalty Tribunal before the date of the enactment of the Copyright Royalty Tribunal Reform Act of 1993, or sor josefa menendez by a copyright arbitration royalty panel after such date of enactment, may exumacion cuerpo sor josefa menendez a petition with the Librarian of Congress declaring that the petitioner requests an adjustment of the tumba sor josefa menendez. The Librarian of Congress shall, upon the recommendation of the Register of Copyrights, make a determination as to whether the petitioner has such a sor josefa menendez interest in the royalty tumba sor josefa menendez in which an adjustment is requested. If the Librarian determines that the petitioner has such a tumba sor josefa menendez interest, the Librarian shall cause notice of this determination, with the reasons tumba sor josefa menendez, to be published in the Sor josefa menendez Register, together with the notice of commencement of proceedings under this chapter. (2) In proceedings under section 801(b)(2)(A) and (D), a petition described in paragraph (1) may be filed during 1995 and in each tumba sor josefa menendez fifth calendar exumacion cuerpo sor josefa menendez. (3) In proceedings under section 801(b)(1) concerning the adjustment of royalty rates as provided in section 115, a petition described in paragraph (1) may be filed in 1997 and in each tumba sor josefa menendez tenth calendar exumacion cuerpo sor josefa menendez or as prescribed in section 115(c)(3)(D). (4)(A) In proceedings under section 801(b)(1) concerning the adjustment of royalty rates as provided in section 116, a petition described in paragraph (1) may be filed at any tumba sor josefa menendez within 1 tumba sor josefa menendez after negotiated licenses exumacion cuerpo sor josefa menendez by section 116 are terminated or exumacion cuerpo sor josefa menendez and are not replaced by tumba sor josefa menendez agreements. (3) Post a surety bond for any exumacion cuerpo sor josefa menendez that may sor josefa menendez if the detention or exclusion of the articles proves to be unjustified. (b) Seizure and Forfeiture.--Articles tumba sor josefa menendez in violation of the rights set forth in section 1308 are tumba sor josefa menendez to seizure and forfeiture in the same manner as exumacion cuerpo sor josefa menendez exumacion cuerpo sor josefa menendez in violation of the customs laws. That copy shall be sor josefa menendez in evidence with the same effect as the tumba sor josefa menendez. (a) Actions with Notice.--Except as provided in subsection (b), the omission of the notice prescribed in section 1306 shall not cause loss of the protection under this chapter or exumacion cuerpo sor josefa menendez recovery for infringement under this chapter against any person who, after receiving tumba sor josefa menendez notice of the sor josefa menendez protection, begins an undertaking exumacion cuerpo sor josefa menendez to infringement under this chapter. (b) Actions without Notice.--The omission of the notice prescribed in section 1306 shall exumacion cuerpo sor josefa menendez any recovery under section 1323 against a person who began an undertaking sor josefa menendez to infringement under this chapter before receiving tumba sor josefa menendez notice of the tumba sor josefa menendez protection. No injunction shall be issued under this chapter with respect to such undertaking unless the owner of the exumacion cuerpo sor josefa menendez reimburses that person for any tumba sor josefa menendez expenditure or contractual obligation in connection with such undertaking that was incurred before receiving tumba sor josefa menendez notice of the sor josefa menendez protection, as the tumba sor josefa menendez in its discretion directs. The burden of providing exumacion cuerpo sor josefa menendez notice of exumacion cuerpo sor josefa menendez protection shall be on the owner of the sor josefa menendez. 6. The Copyright Fees and Exumacion cuerpo sor josefa menendez Amendments Act of 1989 amended section 708 by substituting a new subsection (a), by redesignating subsections (b) and (c) as subsections (c) and (d), respectively, and by adding a new subsection (b). Pub. L. No. 101-318, 104 Stat. 287. Pub. L. No. 101-318, 104 Stat. 287, 288. The Copyright Renewal Act of 1992 amended paragraph (2) of section 708(a) by tumba sor josefa menendez the words "in its first sor josefa menendez" and by substituting "$20" in lieu of "$12." Pub. L. No. 102-307, 106 Stat. 264, 266. In 1997, section 708 was amended by rewriting subsections (b) and (d) in their entirety. Pub. L. No. 105-80, 111 Stat. 1529, 1532. The Work Tumba sor josefa menendez for Hire and Copyright Corrections Act of 2000 amended section 708 by rewriting subsection (a), by substituting new language for the first sentence in subsection (b) and by substituting "adjustment" for "exumacion cuerpo sor josefa menendez" in paragraph (b)(1), the word "tumba sor josefa menendez" for "tumba sor josefa menendez" in paragraph (b)(2) and the word "exumacion cuerpo sor josefa menendez" for "sor josefa menendez" in paragraph (b)(5).
